DOT FMCSA Drug & Alcohol Clearinghouse Registration

Mandatory DOT FMCSA Drug & Alcohol Clearinghouse Registration begins on January 6th, 2020

On December 5, 2016, Congress implemented a rule that established a drug and alcohol clearinghouse that will contain records of drug and alcohol program violations, including positive drug and alcohol tests results or test refusals along with information pertaining to completed return-to-duty (RTD) processes and follow-up testing plans.  This applies only to commercial driver’s license (CDL) and commercial learner’s permit (CLP) holders.  The Clearinghouse will be launched on January 6, 2020 and employers of CDL/CLP drivers will be required to register and report such information to the Clearinghouse if a subject driver violates drug and alcohol programs.  The purpose of this database is to give employers, the Federal Motor Carrier Safety Administration (FMCSA), State Driver Licensing Agencies (SDLAs), and State law enforcement personnel real-time information about commercial driver’s license (CDL) and commercial learner’s permit (CLP) holders’ drug and alcohol program violations. Employers, drivers, medical review officers (MROs), substance abuse professionals (SAPs), and consortia/third-party administrators (C/TPAs) must register in the Clearinghouse to access the Clearinghouse.

 

Employers will also use the database to check for violations of prospective CDL/CLP employees. Drivers are not required to register for the Clearinghouse. However, a driver will need to be registered to provide electronic consent in the Clearinghouse if a prospective or current employer needs to conduct a full query of the driver’s Clearinghouse record—this will include all pre-employment queries beginning on January 6, 2020.  A driver must also be registered to electronically view the information in his or her own Clearinghouse record. 

 

None of the other DOT procedures for transportation workplace drug and alcohol testing have changed.
